Age Requirements
You must meet the following minimum age requirements to purchase Banner Harvest products: 21 years of age or older for all ingestible products including tinctures, capsules, gummies, and edibles, all smokable or vapeable products, and all Delta 8 THC products. 18 years of age or older for all topical products including salves, balms, and creams. No minimum age requirement for pet wellness products. These requirements are set in accordance with Florida law. By completing a purchase, you confirm that you meet the applicable age requirement for the products in your order.

You may cancel or modify your subscription at any time through your account or by contacting us before your next scheduled processing date. Cancellations made after a subscription order has been processed will be subject to our standard refund policy.

Banner Harvest LLC does not manufacture these products and makes no representations or warranties regarding their formulation, efficacy, or safety beyond what is provided by the manufacturer. By purchasing a curated supplement product, you acknowledge that Banner Harvest is acting as a retail reseller only and assumes no liability for adverse reactions, product defects, or outcomes related to third-party manufactured products. In-Store Wellness Services — AO Scan and Theraphi

By scheduling and participating in any Banner Harvest wellness service, you voluntarily assume all risks associated with the use of these technologies. You acknowledge that you have been informed of the experimental nature of these services and that Banner Harvest LLC, its owners, and its staff assume no liability for any outcomes, reactions, or effects experienced during or after a session. Participation in any wellness service constitutes your informed consent and agreement to these terms.
Delta 8 THC Products — Customer Responsibility for State Law Compliance
Delta 8 THC is a hemp-derived cannabinoid that is federally legal under the 2018 Farm Bill, which permits hemp-derived products containing no more than 0.3 percent Delta-9 THC by dry weight. Banner Harvest LLC is based in and operates in compliance with federal law and the laws of the State of Florida, where Delta 8 THC products are legal.
State and local laws governing Delta 8 THC vary significantly and change frequently across the country. Banner Harvest LLC does not track, monitor, or guarantee the legal status of Delta 8 THC in any state, county, or municipality other than Florida, and we make no representation that our Delta 8 THC products are legal to possess or receive in your specific jurisdiction.
It is solely and entirely the customer’s responsibility to research and confirm the legal status of Delta 8 THC products under the laws of their own state, county, and local jurisdiction before placing an order. Banner Harvest LLC assumes no responsibility and bears no liability whatsoever for a customer’s decision to purchase Delta 8 THC products, for any legal consequences a customer may face under their local laws, or for any package seized, returned, refused, or destroyed as a result of state or local enforcement action.

State Shipping Restrictions
Banner Harvest LLC is based in Leesburg, Florida and operates in compliance with federal law under the 2018 Farm Bill and the laws of the State of Florida. We ship hemp-derived CBD and cannabinoid products to the 48 contiguous United States, subject to state-level restrictions that vary by product category.
State laws governing hemp, CBD, and Delta 8 THC change frequently and without notice. While Banner Harvest maintains an active checkout restriction system that prevents shipment of restricted products to states where they are currently prohibited, it remains solely the customer’s responsibility to verify the legality of any product in their own state, county, and local jurisdiction before placing an order.
Banner Harvest LLC does not guarantee the accuracy or completeness of its state restriction system at any given time. Laws may change between the time a restriction list is updated and the time an order is placed.
Current restriction categories as of June 2026:
Total restriction: Tennessee. No CBD, hemp, or cannabinoid products of any kind can be shipped to Tennessee. Customers in Tennessee may purchase Apothecary supplement products only.
Isolate only: Idaho, New Hampshire. Only CBD isolate products (containing non-detectable THC) and Apothecary supplements may be shipped to these states. Full spectrum CBD products, Delta 8 THC products, and full spectrum topicals cannot be shipped to these states.
No Delta 8 THC: Arkansas, California, Connecticut, Iowa, Kansas, Michigan, Mississippi, Montana, Nevada, New Jersey, New York, North Dakota, Oregon, South Dakota, Utah. Delta 8 THC products cannot be shipped to these states. All other CBD products and Apothecary supplements remain available.
This list is subject to change without notice. Banner Harvest LLC is not responsible for orders placed in error, for packages seized or destroyed by state or local authorities, or for any legal consequences a customer may face under the laws of their jurisdiction. By completing a purchase, you confirm that you have independently verified the product is legal for you to receive and possess in your state and locality.
Sales Tax — Florida Nexus
Banner Harvest LLC maintains a sales tax nexus in the state of Florida only. Applicable Florida state and county sales tax is collected and remitted on all orders delivered to a Florida address. For orders shipped to states other than Florida, Banner Harvest LLC does not collect or remit sales tax. Customers located outside Florida may be responsible for self-reporting and paying applicable use tax on their purchases under the laws of their state. Banner Harvest LLC is not liable for any tax obligations arising in states where we do not maintain nexus.
Hemp Law Compliance — Federal and Florida
All products sold by Banner Harvest LLC are derived from hemp as defined by the Agricultural Improvement Act of 2018 (the 2018 Farm Bill) and contain no more than 0.3 percent Delta-9 THC by dry weight, in compliance with federal law. Banner Harvest LLC operates in full compliance with the Florida Department of Agriculture and Consumer Services hemp regulations, including all applicable licensing, testing, and labeling requirements. Every product is tested by an independent third-party laboratory for potency, pesticides, heavy metals, microbials, and residual solvents. Certificate of Analysis documents are available upon request. Nothing in these Terms constitutes legal advice.
